Governor Cuomo recently extended non-discrimination protections to transgender New Yorkers. The Governor’s administration will be clarifying regulations that incorporate gender identity in the definitions of sex and disability. This incorporation is monumental for the Transgender community because this inclusion is protected under the state’s non-discrimination law.
The Human Rights Campaign (HRC) applauded Governor Cuomo’s historic action to protect Transgender New Yorkers. The state’s new regulation is being built upon the 2012 decision in Macy v. Holder where the discrimination of someone based on their gender identity was determined to be sex discrimination and therefore a violation of the Civil Rights Act.
